Release and Waiver of Liability Agreement
By submitting your order, you agree to the following release and waiver of liability for https://tswoffroad.com and all associated products and services.
WHEREAS, AFTER HOURS AUTOMOTIVE & MOBILE REPAIR, LLC DBA Texas Shock Works LLC (“After Hours”) is a mobile repair shop providing services to customer vehicles, located at 602 East Front Street, Hutto, Texas 78634.
Each person signing below hereby stipulates and agrees to the following:
1. Repair of Vehicle
I understand and agree that After Hours will not be liable for damages to my vehicle during and/or after repair — with or without third-party installation and
services. I further agree that I am solely responsible for the proper use and care of my vehicle following any services or products provided by After Hours.
I assume full liability for any damage, destruction, or loss to my vehicle during and after repair, whether by After Hours or a third party.
I voluntarily and freely assume all risks and dangers that may arise from such repairs, including risks of injury, death, or property damage.
2. Release from Liability
On behalf of myself, my heirs, and personal representatives, I fully and forever discharge After Hours and its affiliates, partners, agents, operators,
managers, employees, and representatives (“Released Parties”) from any and all claims - known or unknown - arising from parts, service or repair of my
vehicle.
This includes, but is not limited to, any injury, disability, death, damage, or expenses, whether caused by negligence or otherwise.
This release is intended to be a complete waiver of all liability by the Released Parties.
3. Covenant Not to Sue
I agree, for myself and my heirs, not to sue the Released Parties or assist in any claim for damages related to any personal injury, death, or property
damage I may suffer resulting from After Hours service or repair of my vehicle.
4. Indemnification
I agree to defend, indemnify, and hold harmless After Hours and the Released Parties from and against any third-party claims, losses, damages, suits, or
expenses (including reasonable attorney fees) arising from service or repair of my vehicle.
5. Responsibility for Personal Property
I acknowledge that I am solely responsible for all property and personal belongings in my vehicle. After Hours is not responsible for - nor provides any
security for - such items.
6. No Representations by After Hours
I acknowledge that After Hours makes no representations or guarantees regarding the condition or safety of my vehicle. I accept the vehicle in “AS IS”
condition and am not relying on any statements not explicitly stated in this agreement.
7. Governing Law and Venue
This agreement shall be governed by and construed in accordance with the laws of the State of Texas, without regard to conflict of law principles.
8. Waiver
No waiver of any term shall be valid unless in writing and signed by an authorized representative. Failure to enforce any part of this agreement shall
not be deemed a waiver of that or any other provision.
9. Survival
Any provision requiring performance after termination of this agreement shall survive and remain effective.
10. Compliance with Laws
Both parties shall comply with all applicable federal, state, regional, and local laws in connection with this agreement and the services rendered.
11. Severability
If any provision of this agreement is deemed illegal or unenforceable, the remaining provisions shall remain in full force and effect.
12. Entire Agreement; Modification; Binding Effect
This agreement constitutes the entire understanding between the parties. No modifications shall be valid unless in writing and signed by both parties.
This agreement is binding upon successors, assigns, and legal representatives.
13. Acknowledgment
I acknowledge that I have fully read and understand the above provisions.
I am at least 18 years of age, fully competent, and voluntarily enter into this agreement, intending to be legally bound.
